Terms & Conditions and Service Agreement

OnPark Corporation is a unique company; It operates in concert with our associate towing carriers.


OnPark is involved strictly in Policy/Enforcement, and revenue administration and recovery.

We manage many sites in the Region along with Regional Housing and several Student Living

sites while also managing parking incomes and Special Event parking. OnPark Corporation is

involved in all aspects of parking, including: daily operation of parking surfaces in several

municipalities, event parking for sporting events and festivals, residential parking

systems, monitoring of authorized clients, and Parking Policy Enforcement including onsite

monitoring and vehicle relocation.

 

Currently, we monitor approximately 20,000 parking spaces throughout the Niagara Region.


Our associate towing carriers are involved in the relocation of Motor Vehicles on both OnPark

Managed sites and City properties, as well as Regional and Provincial Roadways. We have a longstanding relationship and communications with Regional Police to ensure compliance. Members of our management team are involved in the Niagara Towing Alliance (NTA), this is the body working with the Region on behalf of the towing industry to ensure fairness and compliance.


Our protocol prior to vehicle relocation is as follows:

  1. Our Onsite Investigator will observe the subject parking the vehicle and leaving the property or otherwise violating parking policy.
  2. The Investigator will then note the time and date by email to ensure a date stamp. This may include photographic evidence of the subject vehicle and operator.
  3. The Investigator will then assess the violation of the posted policies by either time or direct violation, whichever is applicable.
  4. After reviewing the protocol and policies, the Investigator will then call for vehicle relocation.
  5. The Towing operators are then dispatched. A marked and inspected tow vehicle bearing a regional license number and the company name will arrive onsite. (Note: Two operators are always present in order to ensure public safety and continuity of service. All vehicles and markings are inspected and approved by the regional licensing authority and the O.P.P.) All Operators must be cleared via criminal background checks by both Regional Licensing and the O.P.P.
  6.  The operators will then perform a pre-tow inspection to note any prior damage or possible safety concerns that the vehicle in question may cause. If there is any cause for concern the relocation (tow) is cancelled.
  7. After the vehicle condition report has been completed the operators will take a series of photos of the subject vehicle in order to ensure the vehicle is returned in "like-and-kind condition". Our photos are and integral part of our protocol.
  8.  As the vehicle is enroute to our secure licensed compound the Police are notified via email we have set up with them through our unique and longstanding relationship. This ensures a chain of information that not only indemnifies us and our clients, but also allows the police to direct the subject to our Service Desk via our toll free number that we post on all signage.

THE FOLLOWING SHALL BE AN AGREEMENT BETWEEN

ONPARK CORPORATION

(HEREAFTER REFERRED TO AS "THE COMPANY")


AND


The party noted in email containing details and this link

(HEREAFTER REFERRED TO AS THE CLIENT).


THE COMPANY AGREES TO MONITOR THE PROPERTY KNOWN AS: Property details are  noted in email. 



THE PROPERTY IS CURRENTLY BEING USED AS A PARKING LOT, WHERE THE VEHICLES PARKED THERE ARE AUTHORIZED VEHICLES TO PARK ON THE PREMISES.



THE COMPANY WILL, ON A 24 HOUR BASIS REMOVE, OR CAUSE TO BE REMOVED, ALL VEHICLES DEEMED BY THE COMPANY OR CLIENT TO BE WRONGFULLY PARKED OR IN VIOLATION OF THE POSTED POLICIES.


DIRECT MONITORING TO BE APPLIED BASED ON THE CLIENTS REQUESTED METHOD AS DISCUSSED.


THE CLIENT WILL AGREE TO ALLOW UNIMPEDED LEGAL ACTION TOWARDS UNAUTHORIZED VEHICLES AND THEIR OWNER(S).


THE COMPANY WILL NOT DIVULGE THE NAME OF THE CLIENT TO ANY PERSONS UNLESS REQUIRED BY LAW OR WARRANT.


THE CLIENT WILL, AS NEEDED, MAKE THE COMPANY AWARE OF ANY CHANGES IN STAFF OR RESIDENT DETAILS.


THE CLIENT AGREES TO ADVISE THE COMPANY OF ANY CHANGES VIA ADMIN@ONPARK.CA


THE CLIENT WILL ALLOW THE COMPANY TO POST SIGNAGE RELATING TO THE MONITORING OF THE PROPERTY AND TOWING OF VEHICLES WRONGFULLY PARKED.


IT IS AGREED BY BOTH PARTIES THAT THE COMPANY WILL ACT AS AGENT FOR THE CLIENT ON SITE WITH RESPECT TO PARKING RELATED ISSUES AS THEY OCCUR. THERE WILL BE NO COST ON A PER ISSUE BASIS TO THE CLIENT. THE CLIENT AGREES TO PAY $1.00, A ONE TIME FEE, TO THE COMPANY FOR THE SERVICES RENDERED.


BOTH PARTIES MAY CANCEL THIS AGREEMENT WITH 30 DAYS NOTICE.


By acknowledging these terms and via email response, you give OnPark Colour of Right for enforcement actions at the property noted above.
